FluxCMSThese Terms govern your use of FluxCMS (“FluxCMS”, “we”, “us”), a digital signage platform provided by BoostCyber. FluxCMS includes a web dashboard for creating and managing on-screen content and the FluxCMS Player app for Android TV / Fire TV. By creating an account or using the service, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind that company.
FluxCMS lets you design content, assign it to screens you control, and manage those screens remotely. We provide the service on a subscription basis as described on our pricing page.
You own the content you upload. We claim no ownership over your designs, images, videos, or data. You grant us only the limited licence needed to host, process, and deliver that content to the screens you designate — that is, to operate the service for you.
You are responsible for having the rights to the content you display, including any images, fonts, video, music, or third-party feeds. You must not use FluxCMS to display content that is unlawful, infringing, deceptive, harassing, or that violates the rights of others.
Don’t misuse the service. Specifically, you may not:
Each plan includes limits on screens, storage, team members, and a monthly fair-use bandwidth allowance. We may enforce these limits automatically — for example, by declining an upload that would exceed your storage, or declining to pair a screen beyond your plan’s allowance.
We work to keep FluxCMS available and reliable, but the service is provided “as is” without a guaranteed uptime commitment unless your plan includes a written SLA. We may modify, suspend, or discontinue features, and we perform maintenance that can cause brief interruptions.
You may stop using the service and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms, fail to pay, or use the service in a way that risks harm to others or to us. On termination, your right to use the service ends; you can request an export or deletion of your data as described in our Privacy Policy.
To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that content will always display without fault.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold us harmless from claims arising out of the content you display through FluxCMS or your violation of these Terms or applicable law.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in the dashboard). Continuing to use the service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. The courts located in Washington will have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
