FluxCMSTerms of Service
These Terms govern your use of FluxCMS (“FluxCMS”, “we”, “us”), a digital signage platform provided by BoostCyber. FluxCMS includes a web dashboard for creating and managing on-screen content and the FluxCMS Player app for Android TV / Fire TV. By creating an account or using the service, you agree to these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind that company.
The service
FluxCMS lets you design content, assign it to screens you control, and manage those screens remotely. We provide the service on a subscription basis as described on our pricing page.
Your account
- You must provide accurate information and keep your password secure.
- You are responsible for all activity under your account and for your team members’ use.
- You must be at least 18 years old, or the age of majority where you live.
- You may not share credentials or resell access to the service.
Your content
You own the content you upload. We claim no ownership over your designs, images, videos, or data. You grant us only the limited licence needed to host, process, and deliver that content to the screens you designate — that is, to operate the service for you.
You are responsible for having the rights to the content you display, including any images, fonts, video, music, or third-party feeds. You must not use FluxCMS to display content that is unlawful, infringing, deceptive, harassing, or that violates the rights of others.
Acceptable use
Don’t misuse the service. Specifically, you may not:
- Break the law, infringe intellectual property, or display content you lack rights to.
- Attempt to access other customers’ data, probe or breach our security, or disrupt the service.
- Reverse engineer, resell, or white-label the service except as your plan expressly permits.
- Use the service to send spam or to store or transmit malware.
Plans, trials, and billing
- Free plan. Available at no cost, with the limits shown on our pricing page, including a “Powered by FluxCMS” badge shown on your screens.
- Trials. Paid plans may include a free trial. If you do not cancel before the trial ends, the subscription begins and your payment method is charged.
- Subscriptions. Paid plans are billed monthly in advance and renew automatically until cancelled. Prices are in US dollars and exclude taxes unless stated.
- Payments. Payments are processed by Stripe. We do not receive or store your full card details. Your use of payment features is also subject to Stripe’s terms.
- Cancellation. You can cancel any time from the billing portal in your dashboard. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds. Payments are non-refundable except where required by law. We do not provide refunds or credits for partial periods or unused time.
- Changes in price. We may change prices with at least 30 days’ notice. The new price applies from your next billing period; you may cancel before it takes effect.
- Non-payment. If a payment fails, we may suspend or downgrade your workspace to the Free plan after reasonable attempts to collect.
Plan limits
Each plan includes limits on screens, storage, team members, and a monthly fair-use bandwidth allowance. We may enforce these limits automatically — for example, by declining an upload that would exceed your storage, or declining to pair a screen beyond your plan’s allowance.
Availability
We work to keep FluxCMS available and reliable, but the service is provided “as is” without a guaranteed uptime commitment unless your plan includes a written SLA. We may modify, suspend, or discontinue features, and we perform maintenance that can cause brief interruptions.
Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms, fail to pay, or use the service in a way that risks harm to others or to us. On termination, your right to use the service ends; you can request an export or deletion of your data as described in our Privacy Policy.
Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that content will always display without fault.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnity
You agree to indemnify and hold us harmless from claims arising out of the content you display through FluxCMS or your violation of these Terms or applicable law.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in the dashboard). Continuing to use the service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. The courts located in Washington will have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.
